Proposed Language
The San Marcos River State Park is established under the jurisdiction of the department on property that is owned by the state of Texas. The upstream boundary of the park will be the River Center in San Marcos, and the downstream boundary will be Independence Park in Gonzales.
(a) The department will honor all existing easements on the property described under this Act, as well as all existing permits to pump water from the San Marcos River and to discharge water into the San Marcos River.
(b) The department may charge a concession fee from any commercial business operating within the state owned streambed.
(c) The department may charge a fee for entering or exiting the river through land acquired by the department, but may not charge a fee for navigating or traveling on the river.
